Terms of Use
Terms of Use for SEQUIN KINETIC.
1. Scope
These Terms govern SEQUIN KINETIC, local creative software sold by SEQUIN CREATIVE for USD 199 ($199) as a one-time purchase with no subscription. Each purchase licenses use on one active PC at a time. Deactivate the old PC before activating a new PC. The product Requirements and Japan commercial disclosure form part of the purchase information.
2. Rights to materials
You may use only materials that you created yourself or for which you have the rights and permissions necessary for the intended use.
You must not use materials in a way that infringes another person’s copyright, trademark, portrait/publicity rights, privacy rights or other rights.
3. Ownership of user materials
SEQUIN CREATIVE does not acquire ownership of your input materials merely because you use the software.
4. Prohibited use
- Illegal use.
- Use intended to infringe or facilitate infringement of third-party rights.
- Use that violates product-specific restrictions stated before purchase.
5. Rights confirmation in the product
You are responsible for confirming the rights and permissions needed for the materials you use, including when the product presents a rights reminder.
6. Purchase, cancellation and refunds
Purchases are non-refundable for customer convenience, including change of mind or subjective expectations. Exceptions include duplicate charges, inability to provide the purchased product for reasons attributable to SEQUIN CREATIVE or delivery, refunds required by applicable law, and exceptions expressly stated in these Terms or the commercial disclosure. Applicable Stripe Managed Payments / Link payment terms and refund rights are unaffected. Contact contact@sequin-creative.com for assistance.
7. Updates
We may provide bug fixes and security fixes for the purchased version. If a serious issue requires withdrawal, we correct and re-verify the affected behavior before releasing a corrective build; that corrective build is provided to existing purchasers without additional charge. Future major versions or upgrades may be offered separately. Their scope, availability and terms are stated with each offer; this purchase does not promise every future major version or indefinite updates.
8. No broad license in user inputs
SEQUIN CREATIVE does not claim ownership of user creative inputs (including character artwork and PSD assets) merely through use of SEQUIN KINETIC, and does not require a broad license to those inputs beyond what is needed to operate the software on the user’s device. Product-specific licenses, if any, will be stated explicitly before purchase.
9. Warranty, liability and support
Results depend on the source materials and supported environment. We do not guarantee a particular creative result or uninterrupted, error-free operation. Contact contact@sequin-creative.com for product and delivery support. Our liability is determined by applicable law. Nothing in these Terms excludes or limits liability for intentional misconduct or gross negligence, or any consumer right or remedy that cannot lawfully be excluded or limited.
10. Governing law and dispute handling
These Terms are governed by Japanese law, subject to mandatory consumer protections that apply to you. Disputes are handled by courts with jurisdiction under applicable law; these Terms do not impose an exclusive court that overrides those protections.

利用規約
SEQUIN KINETICの利用規約です。
1. 適用範囲
本規約は、SEQUIN CREATIVEが提供するローカル制作ソフトウェアSEQUIN KINETICの利用に適用されます。価格はUSD 199（$199）の買い切りで、サブスクリプションはありません。1購入につき同時に利用可能な端末は1台です。新しい端末を認証する前に旧端末の認証を解除してください。商品ページの動作環境および特定商取引法に基づく表記も購入条件の案内に含まれます。
2. 使用素材の権利
利用者は、自作した素材、または予定する利用に必要な権利・許諾を有する素材のみを使用してください。
第三者の著作権、商標権、肖像権・パブリシティ権、プライバシー権その他の権利を侵害する態様での素材利用を禁止します。
3. ユーザー素材の所有権
SEQUIN CREATIVEは、ソフトウェアを利用したことのみを理由として入力素材の所有権を取得しません。
4. 禁止事項
- 違法な目的での利用。
- 第三者の権利を侵害し、または侵害を助長する目的での利用。
- 購入前に示す製品固有の制限に反する利用。
5. 製品UIでの権利確認
製品に権利確認の注意表示がある場合も含め、使用する素材について必要な権利・許諾を確認する責任は利用者にあります。
6. 購入・キャンセル・返金
購入後の気変わりや主観的な期待との差など、お客様都合による返品・返金・キャンセルは受け付けません。ただし、二重決済、SEQUIN CREATIVEまたは配布側の事情による購入商品の提供不能、適用法令により必要な返金、本規約または特定商取引法に基づく表記で明示する例外を除きます。適用されるStripe Managed Payments／Linkの決済条件および返金に関する権利を妨げません。お問い合わせはcontact@sequin-creative.comへお願いします。
7. アップデート
購入バージョンに対するバグ修正・セキュリティ修正を提供する場合があります。重大な問題により公開停止が必要な場合は、原因を修正し、影響箇所を再検証したうえで改善版を公開します。当該改善版は既購入者へ追加料金なしで提供します。将来の大型バージョンやアップグレードは別途提供する場合があり、対象・提供条件は各案内で明示します。本購入は、すべての将来の大型版や無期限の更新を約束するものではありません。
8. 入力素材に関する広範なライセンスの否認
SEQUIN CREATIVEは、SEQUIN KINETICの利用のみを理由にユーザーの創作入力（キャラクター素材・PSD等を含む）の所有権を主張せず、利用者の端末上でソフトウェアを動作させるために必要な範囲を超える広範なライセンスを求めません。製品固有のライセンスがある場合は購入前に明示します。
9. 保証・責任・サポート
結果は入力素材や対応環境により異なり、特定の創作結果、無停止または不具合のない動作を保証するものではありません。製品・配布に関するサポート窓口はcontact@sequin-creative.comです。当事業者の責任は適用法令に従います。故意・重過失による責任、その他消費者保護法令等により排除・制限できない責任、権利および救済を、本規約により排除・制限することはありません。
10. 準拠法・紛争解決
本規約の準拠法は日本法とします。ただし、利用者に適用される強行的な消費者保護法令の適用を妨げません。紛争は適用法令により管轄を有する裁判所で取り扱い、これらの保護に反する専属管轄は定めません。
